1. Acceptance of These Terms

By visiting cosmeeworld.com (“Site”), creating an account, purchasing a product, or using any COSMEE mobile/web application (collectively, the “Services”), you agree to be bound by these Terms, our Privacy Policy, and our Returns & Refunds Policy.
If you do not accept every part of the Terms, do not use the Services.

2. Eligibility

  • You must be 18 years or older, or at least 14 with verifiable parental consent.

  • You affirm that you reside in a jurisdiction where use of our skincare products and AI diagnostic tools is lawful.

3. Account Registration & Security

  • Provide accurate, current, and complete information and keep it updated.

  • You are responsible for all activity under your credentials—safeguard them.

  • One account per person; resale of accounts or products is prohibited.

4. The Services

COSMEE SKIN AI‑PRO offers:

  1. AI‑based facial‑skin diagnostics via uploaded photographs;

  2. Personalised product recommendations and custom formulations;

  3. Optional subscription programmes (Smart Beauty System “SBS”).

The AI outputs (“Results”) depend on the quality of the data (“Inputs”) you supply. Results are cosmetic in nature and not medical advice.

5. Licence & Intellectual‑Property Rights

  • We grant you a non‑exclusive, non‑transferable, revocable, worldwide licence to access and use the Services for personal skincare only.

  • COSMEE retains all IP rights in the Site, software, brand names, content, and underlying technology.

  • You may not reverse‑engineer, resell, scrape, or otherwise exploit our Services without written permission.

6. User Content & Feedback

  • You retain ownership of photos, comments, and other materials you upload (“User Content”).

  • You grant COSMEE a world‑wide, royalty‑free licence to store, use, and anonymise User Content to improve algorithms and marketing.

  • Do not post content that is illegal, harmful, defamatory, obscene, or infringes any third‑party right. We may remove or block such content at our discretion.

7. Prices, Billing & Subscriptions

  • Current prices for products and SBS membership are displayed at checkout and may change with 30 days’ emailed notice.

  • For SBS, the payment card on file is charged automatically until you cancel through your account or by emailing support@cosmeeworld.com at least 5 business days before the next ship date.

  • You are responsible for any taxes and import duties in your jurisdiction.

8. Shipping, Returns & Refunds

  • Shipping risk passes to you on delivery to the carrier.

  • Our Returns & Refunds Policy (10‑day window; exceptions for custom products) is incorporated by reference.

9. Modifications to the Service or Terms

We may update Services or these Terms at any time. Material changes will be announced by email or on the Site at least 10 days before taking effect. Continued use after that date constitutes acceptance.

10. Third‑Party Materials

Links or references to third‑party sites or healthcare providers are provided “as‑is.” COSMEE does not endorse or warrant third‑party content.

11. Prohibited Conduct

You agree not to:

  • Violate any law or regulation;

  • Upload malware or spam;

  • Harvest data from other users;

  • Interfere with network security or Service integrity;

  • Use the Services for commercial resale without permission.

12. Disclaimers

  • Services and Products are provided “as‑is” and “as‑available.”

  • COSMEE makes no medical claims; consult a qualified professional for medical concerns.

  • We disclaim all implied warranties to the fullest extent allowed by law.

13. Limitation of Liability

To the maximum extent permitted:

  • COSMEE shall not be liable for indirect, incidental, special, or consequential damages.

  • Our total aggregate liability shall not exceed US $100 or the amount you paid us in the previous 12 months, whichever is greater.

  • New Jersey residents retain non‑waivable statutory rights.

14. Indemnity

You will indemnify and hold COSMEE, its directors, and employees harmless from any claim or demand arising out of (i) your misuse of the Services, (ii) your breach of these Terms, or (iii) your violation of any law or third‑party right.

15. Dispute Resolution & Arbitration

PLEASE READ CAREFULLY – THIS AFFECTS YOUR RIGHTS

  • Binding Arbitration: Any dispute arising under these Terms will be resolved by confidential, individual arbitration in Dallas County, Texas, under the AAA Consumer Rules.

  • Class‑action waiver: You may bring claims only in your individual capacity, not as a plaintiff or class member in any class or representative action.

  • Opt‑out: You may opt out of arbitration within 30 days of creating your account by mailing a signed notice to COSMEE WORLD LLC, 1756 Lacy Ridge Dr., Belton, TX 76513, USA.

16. Governing Law & Venue

These Terms are governed by Texas and U.S. federal law, without regard to conflict‑of‑laws rules. Subject to the arbitration clause, any suit shall be brought exclusively in the state or federal courts of Texas, USA.

17. Termination

We may suspend or terminate your account immediately for violation of these Terms. Sections regarding IP, disclaimers, limitation of liability, arbitration, and governing law survive termination.
